Insolvency & Restructuring
We have significant experience acting as counsel in most aspects of insolvency law, including:
- Advising trustees in the administration of estates under the Bankruptcy and Insolvency Act (BIA);
- Bringing and opposing bankruptcy applications, filing proofs of claim, responding to stays of proceedings obtained by debtors, and opposing or seeking discharges from bankruptcy;
- Pursuing and litigating debt collections;
- Enforcing security for secured creditors including both personal property, land foreclosures, and other enforcements;
- Advising trustees, debtors and creditors in BIA Proposals;
- Advising on debt restructurings under the Companies’ Creditors Arrangement Act (CCAA) for both creditors and debtors;
- Acting as independent counsel to boards of directors, officers, and monitors in such proceedings;
- Advising on receiverships and liquidations including non-BIA receiverships; and
- Providing priority opinions and litigation services in resolving priority disputes.
